Assisted Living Contract Terminations

This session will educate participants on the requirements under the Assisted Living laws for involuntary contract terminations, non-renewal of contracts, and emergency relocations. Attorneys Rebecca Coffin and Ryan Usher will review facility requirements starting with the pre-termination meeting notice through relocation planning. The session will provide details on appeal hearings, the facility and resident burdens of proof, and common hurdles providers face upon appeals. We will discuss strategies to avoid involuntary terminations and how to address appeal requests. Examples of non-payment and threatening behavioral issues will be addressed in this context.

Rebecca K. Coffin is a Partner with the law firm of Voigt, Rodè, Boxeth & Coffin, practicing in health law including accounts receivable, regulatory compliance and HIPAA compliance. Ms. Coffin represents providers on nursing home and home care licensing including change of ownership. Ms. Coffin also practices in employment law and advises clients on a variety of employment and labor issues. She currently represents a number of nursing homes, home care agencies and assisted living providers.
